		<description>Maybe I&#039;m being naive but is it legal to discriminate against a candidate for their tobacco use?

It seems to me that since tobacco is not an illegal substance this should not be allowed.  Do they do the same thing for someone taking vicodin or the like because it can be habit forming?</description>

Only a version of democracy well off the rails could tolerate otherwise.

Employment-at- will cannot be a pure principle; we make exception for race, gender, and faith at least, and we should for all lawful activities as well. 

Don&#039;t like smoking? Then ban it through the legislative process and not the whim of various employers.  

The idea that an employer may own my  bloodstream (a government agency to boot) is offensive to me beyond description.  The founders would be horrified.</description>
